1. Acceptance of Terms
These Terms of Use govern your access to and use of Capy Days, including its journaling, habit-tracking, task-management, reminder, backup, and progress features.
By creating an account, accessing, or using the App, you agree to these Terms and to our Privacy Policy, which is incorporated by reference.
If you do not agree, do not use the App.
2. Eligibility
You must be at least 13 years old to create an account or use Capy Days.
If you are under the age of legal majority in your jurisdiction, you may use the App only with the involvement and consent of a parent or legal guardian.
By using Capy Days, you represent that you meet these requirements.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
Notify us promptly if you suspect unauthorized use of your account.
4. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of these Terms
- Attempt to access another user's account or data without authorization
- Interfere with, disrupt, or attempt to gain unauthorized access to the App, its servers, or the networks connected to it
- Reverse-engineer, decompile, or otherwise attempt to extract the source code of the App, except where such restriction is prohibited by applicable law
- Upload or transmit viruses, malware, or other harmful code through the App
- Use automated means, including bots or scrapers, to access the App without our written permission
Capy Days is intended to support personal journaling, habit tracking, and self-reflection.
You agree to use it responsibly and consistent with that purpose.
5. Your Content
You retain ownership of the journal entries, habits, tasks, reflections, and other content you create in Capy Days.
By using the App, you grant us a limited license to store, process, and transmit Your Content solely as necessary to provide and improve the App's features, as described in our Privacy Policy.
We do not claim ownership of Your Content and do not share it with other users.
You are solely responsible for Your Content and for ensuring you have the right to enter any information you provide.
6. Intellectual Property
Capy Days' name, logo, branding, user interface, design, and underlying software are owned by the Capy Days developer and protected by applicable intellectual property laws.
Except as expressly permitted by these Terms or by law, you may not copy, modify, distribute, sell, or create derivative works based on the App without our prior written permission.
7. Wellness Disclaimer
Capy Days supports personal journaling, habit tracking, self-reflection, and personal organization.
It is not intended to diagnose, treat, cure, or prevent any medical, mental health, or other condition, and it does not provide medical, psychological, psychiatric, or other professional advice.
Insights, streaks, and reflections generated by the App are based solely on information you enter and are for informational and personal use only.
Do not use Capy Days as a substitute for professional advice, diagnosis, or treatment.
If you are experiencing a medical or mental health emergency, contact your healthcare provider or local emergency services immediately.
You are solely responsible for decisions you make based on your use of the App.
8. Third-Party Services
Capy Days relies on third-party services, including Supabase for authentication and cloud data storage, as well as operating-system notification services to provide optional local reminders.
Your use of the App is also subject to Apple's applicable terms for App Store-distributed apps.
9. Disclaimers
The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the fullest extent permitted by law, the Capy Days developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, productivity, or service interruption, arising from or related to your use of, or inability to use, the App, even if advised of the possibility of such damages.
Nothing in these Terms limits liability where such limitation is prohibited by applicable law.
11. Indemnification
You agree to indemnify and hold harmless the Capy Days developer from any claims, damages, losses, or expenses, including reasonable legal fees, arising from your violation of these Terms or your misuse of the App.
12. Termination
You may stop using Capy Days at any time and may permanently delete your account from Settings, which removes your account and associated data as described in our Privacy Policy.
We may suspend or terminate your access if we reasonably believe you have violated these Terms or that continued access could harm the security or integrity of the App.
Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.
13. Changes to These Terms
We may update these Terms from time to time to reflect changes to the App, legal requirements, or our services.
The "Effective Date" above will be updated when changes are made.
Continued use of the App after updated Terms take effect constitutes acceptance of the revised Terms.
If you do not agree, stop using the App and delete your account.
14. Governing Law
These Terms are governed by the laws of California, USA, without regard to its conflict-of-law principles, except where applicable consumer-protection law requires otherwise.
15. Severability; Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Capy Days regarding the App.
16. Apple App Store Terms
Because Capy Days is distributed through the Apple App Store, the following additional terms apply and take precedence over any conflicting provision above with respect to your relationship with Apple:
- This Agreement is between you and the Capy Days developer only, not Apple, and Apple is not responsible for the App or its content.
- The license granted to you is limited to a non-transferable license to use the App on Apple-branded products you own or control, as permitted by the Usage Rules in Apple's App Store Terms of Service.
- Apple has no obligation to furnish any maintenance or support services for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
- Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the App or your possession or use of the App infringes that third party's intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You and Capy Days acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.
